Welcome to PristinePolishPlus ("we," "us," or "our"). By accessing or using our website and mobile car detailing services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). Please read these Terms carefully. If you do not agree with any part of these Terms, you must discontinue use of our Services immediately.
PristinePolishPlus grants you a limited, non-exclusive, non-transferable license to access and use our Services solely for your personal, non-commercial use, subject to these Terms. Any unauthorized use of our Services is strictly prohibited. We reserve the right to refuse service to anyone for any lawful reason, at any time.
Account Creation: Some features of our Services may require you to create an account. You agree to provide accurate and complete information during registration and to update such information promptly if it changes.
Confidentiality: You are responsible for maintaining the confidentiality of your account credentials and are solely liable for all activities that occur under your account.
Unauthorized Access: If you suspect any unauthorized access to or use of your account, you must notify us immediately.
Scheduling: When you book a mobile car detailing appointment, you agree to provide accurate information about the date, time, and location. We reserve the right to reschedule or cancel appointments due to unforeseen circumstances (e.g., inclement weather, equipment failure). We will make reasonable efforts to notify you in advance of any changes.
Vehicle Condition: You acknowledge that your vehicle's current condition may affect the outcome of our detailing Services. We do not guarantee the removal of all contaminants, stains, or imperfections, especially if they are permanent or beyond reasonable repair.
Client Responsibilities: You must ensure that we have safe and legal access to the vehicle. If we are unable to perform Services due to hazards, obstructions, or any other circumstances beyond our control, we reserve the right to cancel the appointment and charge a reasonable fee.
You agree to use our Services only for lawful purposes and in accordance with these Terms. Prohibited conduct includes, but is not limited to:
All content, trademarks, and other intellectual property ("IP") featured on our website and through our Services are owned by PristinePolishPlus or its licensors. No rights are granted to you in any such IP, except as expressly provided in these Terms. Any unauthorized use of such IP is strictly prohibited.
Our Services may include links to third-party websites or resources for your convenience. PristinePolishPlus does not endorse and is not responsible for the availability, accuracy, or content of these external sites. Your interaction with any third-party website is governed by that site's own terms and policies.
"As Is" Basis: Our Services are provided on an "as is" and "as available" basis without any warranties, express or implied.
No Guarantee: We do not guarantee uninterrupted or error-free access to our Services, nor do we guarantee the accuracy, reliability, or quality of any information obtained through our Services.
Scope of Warranties: To the fullest extent allowed by law, PristinePolishPlus disclaims all implied warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
Indirect Damages: To the fullest extent permitted by law, PristinePolishPlus shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use or inability to use our Services.
Car Detailing Services: While we strive to provide high-quality mobile detailing, we are not liable for damages resulting from existing vehicle conditions, normal wear and tear, or hidden defects that may surface during or after our Services.
Maximum Liability: In any event, our total liability to you shall not exceed the amount you paid (if any) for the specific service giving rise to the claim.
You agree to defend, indemnify, and hold harmless PristinePolishPlus, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of our Services or any violation of these Terms.
Cancellation by You: You may cancel your appointment according to our posted cancellation policy (e.g., 24-hour notice). If you cancel without proper notice, we reserve the right to charge a cancellation fee.
Cancellation by Us: We reserve the right to cancel or reschedule any service for reasons including, but not limited to, bad weather or equipment failure. In such cases, we will offer to reschedule or provide a refund if appropriate.
Refunds: Refunds may be issued at our sole discretion based on the circumstances of the cancellation and any services already rendered.
We reserve the right, at our sole discretion, to suspend or terminate your access to our Services at any time, without notice, if you violate these Terms or engage in conduct that is harmful to us or other users. Upon termination, your right to use our Services will immediately cease.
PristinePolishPlus may revise these Terms at any time without prior notice. Your continued use of our Services after any changes become effective constitutes your acceptance of the revised Terms. It is your responsibility to periodically review these Terms for updates.
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the courts located in Oregon to resolve any dispute arising from these Terms or your use of our Services.
If any provision of these Terms is deemed invalid or unenforceable by a court of competent jurisdiction, that provision shall be construed in a manner consistent with applicable law to reflect the original intent, and the remaining provisions shall remain in full force and effect.
These Terms, along with our Privacy Policy and any other legal notices posted on our website, constitute the entire agreement between you and PristinePolishPlus regarding your use of our Services and supersede all prior agreements, understandings, or representations.
